Terms of Service

General Terms

By downloading, installing, and using Metavia Sync for macOS ("Application"), you confirm that you agree to and are bound by these Terms of Service.

These terms apply to the entire Metavia Sync Application and any communication between you and Metavia Sync.

Under no circumstances shall Metavia Sync be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the Application, even if the developer has been advised of the possibility of such damages. If your use of the Application results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof.

Metavia Sync will not be responsible for any outcome that may occur during the course of usage of the Application.

License

Metavia Sync grants you a revocable, non-exclusive, non-transferable, limited license to install and use the Application on your macOS devices strictly in accordance with these Terms of Service.

These Terms of Service are a contract between you and Metavia Sync (referred to in these Terms of Service as "Metavia Sync", "we", "us" or "our"). The Application and services accessible through it are collectively referred to as the "Service".

You are agreeing to be bound by these Terms of Service. If you do not agree to these Terms of Service, please do not use the Service. In these Terms of Service, "you" refers both to you as an individual and to the entity you represent. If you violate any of these Terms of Service, we reserve the right to revoke your license to use the Application.

Application Description

Metavia Sync is a macOS application designed to help developers manage and translate their App Store Connect metadata. The Application allows you to:

• • Connect to your App Store Connect account using API credentials
• • View and manage your apps and app versions
• • Edit app metadata including names, descriptions, keywords, and what's new sections
• • Translate metadata using AI-powered translation (optional, requires OpenAI API key)
• • Submit updated metadata back to App Store Connect

Use of Third-Party Services

Apple App Store Connect

The Application requires you to provide valid App Store Connect API credentials (Key ID, Issuer ID, and Private Key) to function. By using the Application:

• • You confirm that you have the legal right to access the App Store Connect account
• • You agree to comply with Apple's App Store Connect Terms and Conditions
• • You acknowledge that you are solely responsible for maintaining the security of your credentials
• • You understand that all interactions with App Store Connect are governed by Apple's policies

OpenAI API (Optional)

If you choose to use the AI-powered translation feature, you must provide your own OpenAI API key. By using this feature:

• • You confirm that you have a valid OpenAI account and API key
• • You agree to comply with OpenAI's Terms of Service and Usage Policies
• • You acknowledge that usage charges from OpenAI are your responsibility
• • You understand that translation quality and accuracy depend on OpenAI's service

Firebase Analytics

The Application uses Google Firebase Analytics to collect anonymized usage data. By using the Application:

• • You acknowledge that Firebase Analytics will collect anonymized usage data
• • You understand that this data is used solely to improve the Application
• • You agree that Firebase processes data in accordance with Google's Privacy Policy
• • You acknowledge that Firebase Analytics does NOT collect your credentials or app metadata content

Google AdMob (if implemented)

The Application may display advertisements through Google AdMob. By using the Application with advertisements:

• • You acknowledge that AdMob may collect data about your device and app usage
• • You understand that personalized ads may be displayed based on your interests
• • You agree that AdMob processes data in accordance with Google's Privacy Policy
• • You can manage ad personalization settings through your device settings

Third-Party Services General Terms

The Application uses various third-party services (Apple, OpenAI, Google) to provide its functionality. You acknowledge and agree that:

• • Metavia Sync is not responsible for the availability, accuracy, or functionality of third-party services
• • Each third-party service has its own terms of service and privacy policy that you must comply with
• • Third-party services may change, suspend, or discontinue their services at any time
• • Any costs associated with third-party services (e.g., OpenAI API usage) are your sole responsibility
• • Metavia Sync is not liable for any issues arising from your use of third-party services

Restrictions

You agree not to:

• • Reverse engineer, decompile, or disassemble the Application
• • Remove any copyright or proprietary notices from the Application
• • Use the Application for any illegal purpose
• • Share your license with others or use it on behalf of third parties without authorization
• • Attempt to gain unauthorized access to any systems or networks through the Application
• • Use the Application in any way that could harm, disable, or impair the Application or interfere with any other party's use

Data and Privacy

The Application stores all credentials locally on your device in the macOS Keychain. We do not collect, store, or have access to your App Store Connect credentials, OpenAI API keys, or any of your app metadata content.

Analytics and Usage Data

The Application uses Firebase Analytics to collect anonymized usage data and crash reports to improve the user experience. This analytics data does NOT include your credentials or app metadata content. The data collected includes:

• • Device information (model, OS version)
• • App usage patterns (features used, session duration)
• • Crash reports and error diagnostics
• • Anonymous identifiers
• • General demographics (country/region)

Advertising (if implemented)

The Application may display advertisements through Google AdMob. AdMob may collect data about your device and app usage for advertising purposes. You can learn more about AdMob's data practices in their privacy policy.

Disclaimer of Warranties

The Application is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• • Warranties of merchantability and fitness for a particular purpose
• • Warranties that the Application will be error-free, uninterrupted, or secure
• • Warranties regarding the accuracy or reliability of data or translation services
• • Warranties that the Application will meet your requirements

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL METAVIA SYNC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• • Your use or inability to use the Application
• • Any unauthorized access to or alteration of your data
• • Any errors or omissions in the Application
• • Any interruption or cessation of the Service
• • Any translation errors or metadata issues

User Responsibilities

You are solely responsible for:

• • The security and confidentiality of your API credentials
• • All content you submit or modify using the Application
• • Ensuring compliance with App Store guidelines and policies
• • Backing up your data and metadata before making changes
• • Reviewing all changes before submitting them to App Store Connect
• • Any costs incurred from using third-party services (OpenAI)

Updates and Modifications

We may from time to time provide updates, enhancements, or modifications to the Application. Updates may:

• • Add new features or functionality
• • Fix bugs or improve performance
• • Modify or remove existing features
• • Change the user interface or user experience

You agree that we have no obligation to provide updates and that all updates will be subject to these Terms of Service.

Termination

Your license to use the Application is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of these Terms of Service. Upon termination, you must cease all use of the Application and delete all copies from your devices.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting. Your continued use of the Application after any changes constitutes your acceptance of the new Terms of Service.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions.

Severability

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Metavia Sync regarding the use of the Application.
